H-1B Visas

Foreign nationals coming to the U.S. to perform services in a specialty occupation are classified under H-1B category. A maximum of 65,000 H-1B work visas are issued each year.

The H-1B visa is issued for up to three years but may be extended for another three years. Individuals cannot apply for an H-1B visa to allow them to work in the US. Rather, the employer must petition for entry of the employee.

Specialty occupation is defined as an occupation, which requires:

  • Theoretical and practical application of a body of highly specialized knowledge, and
  • Attainment of a bachelor’s or higher degree in the specific specialty (or its equivalent) as a minimum for entry

Architecture, engineering, mathematics, physical sciences, social sciences, medicine and health, education, business specialties, accounting, law, theology and the arts are specialty occupations.
